2. The petitioner has preferred this application for grant of regular bail in connection with Chakand P.S. Case No. 294 of 2024 dated 29.10.2024 registered for the offences punishable under Sections 80, 238 read with Section 3(5) of Bhartiya Nyaya Sanhita.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have murdered the informant's sister and threw the dead body on the railway track due to non-fulfillment of demand of motorcycle.
4. Learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.28484 of 2025(3) dt.14-05-2025 2/3 that the petitioner has falsely been implicated in this case. The petitioner is the husband of the deceased. There is no specific allegation against the petitioner rather the allegation against the petitioner is general and omnibus in nature. The petitioner neither demanded any dowry nor tortured the informant's sister. It is further submitted that as per post-mortem report, the cause of death is due to haemorrhage and shock due to train accident. The occurrence took place on 29.10.2024 but the FIR was lodged on 27.10.2024 and there is no explanation for this delay. The petitioner has no concern with the alleged offence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 11.01.2025..

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that the marriage of the informant's sister was solemnized with the petitioner on 03.03.2024 and after seven months of the marriage, the informant's sister was committed murder by the petitioner and the co-accused persons.
6. Considering the aforesaid facts and circumstances of the case as well as the heinous nature of offence against the petitioner, this court is not inclined to grant bail to the petitioner and the same is rejected in connection with Chakand P.S. Case
Patna High Court CR. MISC. No.28484 of 2025(3) dt.14-05-2025 3/3 No. 294 of 2024, pending in the Court of learned Additional Chief Judicial Magistrate-V, Gaya.
7. Learned court below is directed to conclude the trial of the petitioner at the earliest.
