The petitioners apprehend their arrest in connection with Nawada P.S. Case No. 391 of 2014, registered under Sections 366(A)/34 of the Indian Penal Code.
The accusation is that petitioner No.2 called Ankit Kumar @ Chhotu, son of the informant, from his rented house for domestic help, but Ankit Kumar did not return to his house. In course of search when petitioner Nos.1 and his daughter met then informant made query about his son then petitioner No.1 told that perhaps his son has been kidnapped for the purpose of marriage. Learned counsel for the petitioners submits that, in fact, the marriage of the second daughter of the petitioners was performed with Ankit Kumar, but with ulterior motive, the informant lodged the
Patna High Court Cr.Misc. No.698 of 2017 (2) dt.19-01-2017 2/2 present case with false allegation of kidnapping and also got recorded statement of victim under Section 164 Cr.P.C. in that regard. Moreover, the dispute has been settled in between the parties and a compromise petition has also been filed in this regard in the Court of Addl. Sessions Judge-II, Nawada at the time of disposal of the ABP No. 831 of 2016 of petitioners on 25.11.2016. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Nawada P.S. Case No. 391 of 2014, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
