Petitioners apprehend their arrest in Chandi P.S. Case No.142 of 2018 registered under Section 307 and other sections of the Indian Penal Code.

The informant named the petitioners and four other accused persons and alleged that they came and began to fill the drainage of the informant. When the informant forbade, the accused persons assaulted his father with lathi and spade. When the informant came to save, Pritam Kumar assaulted the informant.

Learned counsel for the petitioners submits that there is omnibus and general allegation of assault against the accused

Patna High Court CR. MISC. No.27939 of 2019(2) dt.29-04-2019 2/2 persons. All the accused persons are alleged to have assaulted Barak Singh (father of the informant) but Barak Singh got one injury measuring 1"x1" & 1⁄2" x 1⁄2" on skull. The injury opined to be simple caused by hard and blunt object. It is further submitted that similarly situated co-accused Uma Singh and Ajay Singh have already been granted anticipatory bail vide order dated 01.03.2019 passed in Cr. Misc. No.12676 of 2019.

Having considered the fact that similarly situated accused persons have already been granted anticipatory bail, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned 12th Additional Chief Judicial Magistrate, Bhojpur at Ara in connection with Chandi P.S. Case No.142 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
