12-06-2018 Heard Sri Chakrapani, learned counsel assisted by Sri Sanjay Kumar Singh, learned counsel for the petitioner and Sri Rajendra Singh Shastriji, learned Addl. Public Prosecutor. The sole petitioner, apprehending his arrest in Arwal P.S. Case No. 101 of 2018 registered for offence under Section 30(A) of Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail in the event of his arrest or surrender. It was submitted by learned counsel for the petitioner that from premises of Chairman of PACS and from number of vehicles, huge quantity of Indian make foreign liquor was shown to be recovered and petitioner was made accused only on suspicion, as if, petitioner was involved in illegal trade of liquor. Learned counsel for the petitioner further submits that Chairman
Patna High Court Cr.Misc. No.31681 of 2018(2) dt.12-06-2018 2/2 of PACS has already been granted anticipatory bail. Considering the fact that huge quantity of Indian make foreign liquor to the tune of about 396 liters was recovered and there is specific accusation against the petitioner, there is no reason to extend the privilege of anticipatory bail. The petition stands dismissed.
