The petitioner seeks anticipatory bail in connection with Sour Bazar (Baijnathpur O.P.) P.S. Case No. 132 of 2017, registered for offences punishable under Sections 147, 148, 149 and 302 of the Indian Penal Code.
Allegation against the petitioner is that he along with other co-accused persons assaulted to the elder brother of the informant with deadly weapons on account of which he became seriously injured and later on, he was declared dead in the hospital.
Submission of the learned counsel for the petitioner is that there is no any specific allegation has been attributed against the petitioner and other co-accused persons have been granted privilege of bail vide order dated 19.01.2018 passed in Cr. Misc.
Patna High Court Cr.Misc. No.31285 of 2018 (5) dt.05-07-2018 2/2 2925 of 2018. It is also submitted that the petitioner has no criminal antecedent.
Learned A.P.P. opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the date of the order, be released on anticipatory bail on furnishing bail bonds of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Sour Bazar (Baijnathpur O.P.) P.S. Case No. 132 of 2017, S.T. No. 06 of 2018, to the satisfaction of Sri A.N. Jha, learned District and Sessions Judge, Saharsa, subject to the conditions laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned and petitioner shall cooperate in the investigation and shall be present before police as and when required, otherwise prosecution is at liberty to move for cancellation of his bail bonds.
