JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT (Per: HONOURABLE THE CHIEF JUSTICE) Date: 27-07-2017 Petitioner wanted the pay scale which was granted to the Lab Assistant and Lab Technician after merger of the post. However, the same has been denied to the petitioner on account of the fact that the petitioner was neither Lab Assistant nor Lab Technician, he was only Lab Attendant and, therefore, benefit could not be granted to him. On query made, we are informed that the petitioner was only a matriculate, therefore; apparently he does not fulfill the qualification for being appointed as Lab Assistant or Lab Technician.

Patna High Court LPA No.697 of 2014 dt.27-07-2017 2/2 In view of the aforesaid, we find no error in the order passed by the learned Writ Court refusing to grant higher pay scale to the petitioner. The appeal stands dismissed.
