JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 27-07-2017 The instant application has been filed for noncompliance of the order, dated 14.10.2014, passed in C.W.J.C. No. 22151 of 2013, whereby the Court directed the petitioner to file a fresh representation whereafter the respondents would dispose of the same preferably within a period of three months from the date of representation.
Patna High Court MJC No.1067 of 2015 (7) dt.27-07-2017 2/2 The petitioner submits that pursuant to order of this Court, he filed a detailed representation before the respondentsopposite parties. However, his representation was disposed of without considering the relevant materials.
Counsel for the opposite parties submits that the order of this Court has fully complied with and in fact the petitioner has not presented the entire facts to the Court. Furthermore, the writ application was disposed of at the stage of admission, without counter affidavit.
Having heard the counsel for the parties and perused the materials on record, this Court would give one more opportunity to the petitioner to file his representation, which will be considered on its merit without being prejudice. The remand of the matter is not construed that this Court has expressed any opinion on the merit of the case.
This application stands disposed of.
