01-12-2021 At the outset, learned counsel for the petitioner seeks permission to make correction in prayer portion of the bail petition.

Permission is accorded. It may be done in course of the day.

Heard learned counsel for the parties.

The petitioner seeks bail in Dalsingsarai P.S. Case No. 387 of 2020, registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.

252 liters of illicit foreign liquor has been recovered from the farm of co-accused Awadhesh Mahto and this petitioner alongwith other co-accused persons are alleged to have fled away from the spot.

Patna High Court CR. MISC. No.38753 of 2021(2) dt.01-12-2021 2/2 It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. The recovery has been made from the farm of co-accused Awadhesh Mahto. Petitioner has no criminal antecedent and he is in custody since 03.03.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. - II cum Special Judge (Excise), Samastipur in connection with Dalsingsarai P.S. Case No. 387 of 2020.
