Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Bihariganj P.S. Case No. 59 of 2021 lodged under Sections 363 and 366(A)/34 of the I.P.C.
As per prosecution case, the F.I.R. has been filed by the informant alleging therein that her daughter was kidnapped by four accused persons named in the F.I.R..
Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He further submits that antecedent of the petitioner is clean and he is in custody since July, 2021. He further submits that the alleged
Patna High Court CR. MISC. No.28810 of 2022(3) dt.16-11-2022 2/2 victim has already been recovered and in her statement under Section 164 Cr.P.C. she has deposed that she went with the petitioner with her consent and there is no coercion done with her.
Learned counsel for the State opposes the prayer for bail.
In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-V, Madhepura in connection with Bihariganj P.S. Case No. 59 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C..
With this observation, the bail application stands allowed.
