JUSTICE SANJAY PRIYA ORAL ORDER 4/ 31-07-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for the Informant. Petitioner seeks bail in Yogapatti Nawalpur P.S. Case No.609 of 2018 instituted for the offence under Section(s) 406, 420, 504, 506 Indian Penal Code.

It is alleged in the written report that the petitioner, who is founder of Bharat Nav Nirman Trust, Lauriya, took rupees five lac fifty thousand from Informant and rupees fifteen lac from several persons on the pretext of giving employment to them in the said trust and also promised to give salary to the payers but he did not make any payment even after expiry of one year.

Counsel for the petitioner submits that informant has

Petitioner is founder of Bharat Nav Nirman Trust, an autonomous Trust registered under Indian Trust Act, 1882, working for social health programme. The civil remedy is available to the Informant.

Petitioner is in custody since 23.12.2018.

Counsel for the informant has opposed prayer for bail. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Yogapatti Nawapur P.S.
