The present petition has been filed with a prayer to restore CWJC No. 10441 of 2008, which stood dismissed due to non compliance of peremptory order dated 10.4.2015 . Learned counsel for the petitioner submits that due to inadvertence on the part of his clerk the order dated 10.4.2015 was not complied with within time , however after expiry of the time fixed by this court requisites were already filed on 24.4.2015.

Considering the facts and circumstances, the restoration petition stands allowed.

Patna High Court MJC No.2298 of 2015 (2) dt.09-08-2017 2/2 Let CWJC No. 10441 of 2008 be restored to its original file.
