2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 292 of the Indian Penal Code.

3. As per the prosecution case, two unknown miscreants boarded on a motorcycle intercepted the informant and two miscreants boarded on another motorcycle came there and looted a bag from the informant containing original documents of the motorcycle, bank register, laptop, Rs.89,000/- and his mobile phone on the point of katta.

4. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.31589 of 2024(2) dt.02-08-2024 2/3 that the petitioner has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The petitioner is not named in the FIR. The name of the petitioner has surfaced on the basis of the confessional statement of the co-accused, Golu Kumar. The similarly situated co-accused has been granted regular bail by this Court vide order dated 19.09.2022 in Cr. Misc. No. 27883 of 2022. The petitioner has one criminal antecedent as stated at para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, S.D.J.M., Sikarhana at Dhaka, East Champaran in connection with Ghorasahan P.S. Case No. 397 of 2020, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
