====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 29-04-2019 Heard learned counsel for the petitioner and the State.
The petitioner seeks bail in Parasbigha P.S. Case No. 46 of 2019 (Excise Case No. 290 of 2019), instituted for the offence under Section(s) 30(a) of Bihar Prohibition and Excise Act, 2016.
It is alleged in the written report that 45 litres of country made liquor kept in three jerkin has been recovered from village Dihuri near the narrow canal (Pain). The Police saw three persons sitting there. On seeing the policy party they started running away but, one of them was apprehended by the Police. He disclosed his name as Sunil Choudhary (petitioner). Counsel for the petitioner submits that as per seizure list 45 litres of country made liquor has been recovered
Patna High Court CR. MISC. No.27751 of 2019(2) dt.29-04-2019 2/2 from village Dihuri near the Canal (Pain). There is no recovery from conscious possession of the petitioner. He has been made accused merely on suspicion.
Petitioner is in custody since 11.3.2019 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Jehanabad, in connection with Parasbigha P.S. Case No. 46 of 2019 (Excise Case No. 290 of 2019), subject to the condition that both the bailors will be close relatives of the petitioner.
