JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-11-2025 At the outset, the learned counsel for the opposite parties submits that the Circle Officer, Morwa, District-Samastipur has already passed the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956 on 03.08.2023 in connection with Encroachment Case No. 29 of 2022-23,

Patna High Court MJC No.1235 of 2023(3) dt.21-11-2025 2/2 whereby and whereunder it has been found that the land in question is a raiyati land, hence encroachment proceedings have been dropped.

At this juncture, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the aforesaid order dated 03.08.2023, by taking recourse to the due process of law. Liberty, so sought, is granted. 3.

The petition stands disposed off.
