The petitioner apprehends his arrest in Raniganj P.S. case No.283 of 2015 under Section 409, 420 of the Indian Penal Code.
The Block Development Officer, Raniganj alleged that Mukhiya and Panchayat Secretary of Hasanpur, Hasa and Barbanna Panchayat committed financial irregularities and misappropriated Government money in different Government schemes. The petitioner is Panchayat Secretary of Hasanpur Panchayat.
The learned counsel for the petitioner submits that no
Patna High Court Cr.Misc. No.45654 of 2016 (3) dt.24-11-2016 2/2 specific allegation is made against the petitioner. All the three Mukhiya of Hasanpur, Hasa and Barbanna Panchayat have already been granted anticipatory bail vide order dated 05.08.2016 passed in Cr. Misc. No. 20012 of 2016 and one Panchayat Secretary of Hasa Panchayat has also been granted anticipatory bail vide order dated 14.09.2016 passed in Cr. Misc. No. 30262 of 2016. The case of the petitioner stands on same footing.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st class, Araria in Raniganj P.S. Case No. 283 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) BKS/- U T
