JUSTICE MOHIT KUMAR SHAH ORAL ORDER 04-01-2018 Heard the learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks anticipatory bail in connection with Kochadhaman PS case no. 201 of 2014 registered for the offences punishable under Section 07 of the Essential Commodities Act. The allegation is regarding recovery of 50 bags of Urea fertilizer loaded on a vehicle having registration No. BR-37F6841, upon being apprehended by the Circle Officer. The learned counsel for the petitioner submits that the owner of the vehicle, namely, Ajay Lal Harin @ Ajoy Lal Harijan has been granted bail by this Court by an order dated 12.12.2017 passed in Cr. Misc. No. 47148 of 2017. It is further submitted that according to the notification of the Agriculture Department dated

Patna High Court Cr.Misc. No.62147 of 2017 (2) dt.04-01-2018 2/2 17.10.1992, no license is required for possessing Urea below 10 metric tone. It is stated that the petitioner has a clean antecedent. Having regard to the facts and circumstances of the case, in the event of arrest or surrender within six weeks, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Kishanganj in connection with Kochadhaman PS case no. 201 of 2014, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
