Petitioners apprehend their arrest in connection with Basantpur P.S. Case No.109 of 2014 registered under Sections 363-A, 364, 120-B, 323, 504 and 506 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioners submits that the petitioners have falsely been implicated due to land dispute and this complaint case was lodged on 5.3.2014 whereas the alleged occurrence is dated 28.2.2014. Prior to that the petitioner's side had filed the F.I.R. by filing Basantpur P.S. Case No.109 of 2014.
Learned A.P.P. submits that the case diary shows existence of land dispute between both sides and in view of paragraphs 22, 23, 31,
Patna High Court Cr.Misc. No.5614 of 2017 (3) dt.18-03-2017 2/2 35 and 36 of the case diary, it is suspected that the complainant might have concealed his daughter.
Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, namely, Asraf Ansari and Hasan Ansari @ Hasan Ars be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Basantpur P.S. Case No.109 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
