2. The petitioner seeks bail in connection with Mohiuddinnagar P.S. Case No. 253 of 2025 registered for the offence punishable under Sections 331(4), 305(a) and 317(i) of the BNS.
3. As per the prosecution case, unknown persons are said to have committed theft in the dwelling house of the informant. The name of the petitioner has come in the confessional statement of co-accused Prince Kumar.
4. The petitioner is in custody since 10.02.2026 and claims clean antecedent.
5. It has been submitted by the learned counsel for the
Patna High Court CR. MISC. No.28845 of 2026(2) dt.07-05-2026 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in this case. He further submits that there is no recovery of the stolen articles from the petitioner. Lastly, similarly situated co-accused namely, Akash Kumar has been granted bail by this Court vide order dated 01.04.2026 passed in Cr. Misc. No. 20041 of 2026.
6. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
7. Considering the fact that the petitioner is not named in the FIR and his clean antecedent, this application is allowed.
8. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Samastipur, District- Samastipur in connection with Mohiuddinnagar P.S. Case No. 253 of 2025.
9. As the petitioner claims to have clean antecedent, the Court below, before accepting the bail bonds of the petitioner is directed to verify the antecedent of the petitioner. If the petitioner is found to be involved in any other case then the bail bonds of the petitioner shall not be accepted.
10. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at
Patna High Court CR. MISC. No.28845 of 2026(2) dt.07-05-2026 3/3 Mohiuddin Nagar Police Station, District- Samastipur on every Sunday of the month. Any default in appearance at the police station will result in cancellation of bail bonds of the petitioner.
11. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not express any opinion on the merits of the case.
