This application, for grant of anticipatory bail, arises out of Kako P.S. Case No. 108 of 2016, disclosing offences under Sections 379/411 and 414 of the Indian Penal Code. Allegation is that the police party spotted a motorcycle in possession of two persons, who started fleeing away after seeing the police. Upon chase, one of them was arrested whereas the other fled away. The accused, who was arrested, confessed that he had purchased the stolen motorcycle. He disclosed the name of the petitioner as the person, who was there along with him. Learned Senior counsel, appearing on behalf of the petitioner, has submitted that the petitioner has no criminal antecedent and there is no allegation of theft against him. Considering the submission, as above, this application is

Patna High Court Cr.Misc. No.42955 of 2016 (2) dt.24-10-2016 2/2 allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Jehanabad, in connection with Kako P.S. Case No. 108 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself/herself before the police/Court, as the case may be, as and when required and in the event of failure on his/her part to appear before the Court on two consecutive occasions, his/her bail bond shall be liable to be cancelled.
