The petitioner apprehends his arrest in connection with Hajipur P.S. Case no. 684 of 2017, registered under Sections 147, 148, 149, 353, 186, 307, 427, 153(a)(a), 153(a) 295, 298, 296, 505 and 120(B) of the Indian Penal Code. The accusation is of pelting stones by members of unlawful assembly of 100 people, including the petitioner, in course of procession of Durgapuja and Moharam. Learned counsel for the petitioner submits that while petitioner is named in the F.I.R. as a member of the unlawful assembly indulged in pelting stones, but no overt act has been attributed against the petitioner.
Having regard to the facts and circumstances of the
Patna High Court Cr.Misc. No.31173 of 2018(2) dt.11-06-2018 2/2 case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 684 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
