JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-06-2018 The petitioner seeks bail in anticipation of his arrest in connection with Gaurichak P.S. Case No. 269 of 2016, dated 17.11.2016, instituted for the offences punishable under Sections 467, 468, 471, 406, 420 and 34 of the Indian Penal Code.

On a complaint of a local person, the B.D.O. of Punpun Block along with another official of the Block, conducted an enquiry in the office of Halka Karmachari, viz. Vidya Bhushan Singh. He was found absent. However, the petitioner was found dealing with the visitors/applicants in the office. Further enquiry by the B.D.O. revealed that Vidya

No.31814 of 2018 (3) dt.29-06-2018 2/3 Bhushan Singh, the Revenue Clerk, gave pre-signed documents to the petitioner, who, thereafter, filled in the details on the asking of the applicants. It was in this connection, it was found by the B.D.O., that bungling was being resorted to by aforesaid Vidya Bhushan Singh in connivance and active support of the petitioner. Learned counsel appearing for the petitioner has submitted that during the course of investigation, the Circle Officer founds such allegation to be incorrect. It has further been submitted that the petitioner and the aforesaid Vidya Bhushan Singh have been made accused in this case at the instance of Block Pramukh, viz. Gudiya Devi and her husband/Sailesh Patel.

Their earlier demands were not met by the Revenue Karmachari and, therefore, the case has been lodged primarily against Revenue Karmachari (Vidya Bhushan Singh) and the petitioner, who has been an associate of aforesaid Vidya Bhushan Singh for a long time. It has also been submitted that the petitioner is only a villager and has close acquaintance with aforesaid Vidya Bhushan Singh.

Considering the aforesaid aspect, it has been argued, the Court below has granted bail to aforesaid Vidya Bhushan Singh, the Revenue Karmachari.

Regard being had to the aforesaid facts, let the
