JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-07-2019 This is an application for grant of anticipatory bail in connection with Jagdishpur P.S. Case No. 109 of 2018, disclosing offences under Sections 420, 467, 468, 471, 120B of IPC.

Written report disclosed an allegation against the petitioners is that they got a sale deed executed from the accused persons and thereafter, sold the same to some other person though the land belongs to the complainant and the petitioners were got the sale deed registered, showing the complainant dead.

Submission of the learned counsel for the petitioners is that F.I.R. itself shows that petitioners have purchased the said

Patna High Court CR. MISC. No.26850 of 2019(3) dt.09-07-2019 2/2 land from one Md. Munaf and he later on, sold the same to some other person and furthermore, a Title Suit No. 09 of 2018 has been filed by the complainant.

Heard learned A.P.P. as well as learned counsel for the complainant also, they have opposed the prayer for anticipatory bail.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Jagdishpur P.S. Case No. 109 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition that petitioners will appear in the Title Suit bearing No.09 of 2018 within one month.
