2. In the present case, the petitioner is apprehending his arrest in connection with Khodawandpur P.S. Case No. 67 of 2025, dated 18.07.2025, registered for the offences punishable under Sections 96, 126(2), 115(2), 74, 303 and 351 read with Section 3(5) of the B.N.S., 2023.

3. As per prosecution case, petitioner enticed away the minor daughter of the informant. When the informant went to enquire from the family members of the petitioner, she and her daughter were assaulted.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The victim girl has been recovered and her statement was

No.28444 of 2026(2) dt.05-05-2026 2/3 recorded under Section 183 of the B.N.S.S., 2023, wherein she did not state anything adverse against this petitioner, though she has stated that she left her house on her own will due to dispute with her mother. Learned counsel further submits that FIR in this case has been registered after delay of seven days without any satisfactory explanation. There is no material on record to show complicity of the petitioner in the whole occurrence. Learned counsel lastly submits that petitioner has got clean antecedent and is aged about twenty years.

5. Learned APP opposes the submissions made on behalf of the petitioner.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the statement of the victim recorded under Section 183 of the B.N.S.S., 2023, and further considering the possibility of false accusation, let the petitioner, above-named, in the event of his arrest or surrender before the Court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Manjhaul, in connection with Khodawandpur P.S. Case No. 67 of 2025, subject to the

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the Court below, if so required by the learned trial Court.
