JUSTICE ARVIND SRIVASTAVA ORAL ORDER 20-12-2017 Heard learned Counsel for the petitioners and learned Additional Public Prosecutor for the State. This application, for grant of anticipatory bail, arises out of Pakaridyal Police Station Case No. 151of 2016, disclosing offences under Sections 302, 34, and 120-B of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioners has submitted that there is general and omnibus allegation against the petitioner and no specific overt act is attributed to him. In fact, neither the petitioner has played any role in the alleged occurrence nor any cogent material has come against him during course of the investigation rather the petitioner has falsely been implicated on account of earlier dispute between the parties.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Motihari, East Champaran, in connection with Pakaridyal Police Station Case No. 151of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
