JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with POCSO 28 of 2020 arising out of Sasaram (Town) P.S. Case No.167 of 2020 for the offence under Sections 290 and 34 of the Indian Penal Code and Sections 3(1), 3(2), 4, 5, 6 and 7 of the Immoral Trafficking (Prevention) Act 1956 and Section 4/16 of the POCSO Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 03.03.2020.

The allegation against the petitioner is that he was apprehended by the police during raid at Dhaba. It is submitted that in order to facilitate the people at Dhaba, different cabins

Patna High Court CR. MISC. No.29316 of 2020(2) dt.10-11-2020 2/2 were erected and cabins were allowed to be used by the boys and girls for the purpose of committing immoral acts. Learned counsel appearing on behalf of the petitioner would submit that the petitioner is preparing for the competitive examination and his entire career would be ruined if he is not allowed bail.

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 03.03.2020, the Court is inclined to grant bail to him. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of 1st Additional District & Sessions Judge, Rohtas at Sasaram in connection with POCSO 28 of 2020 arising out of Sasaram (Town) P.S. Case No.167 of 2020.
