JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 24-01-2018 The petitioner, being the sister-in-law (Bhabhi) of the husband of the daughter of the informant has renewed the prayer for anticipatory bail in a case registered for the offences punishable under Sections 109, 498A, 324, 326, 307, 302/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act. The prosecution case is that the informant's daughter was married with Ramjeet Yadav on 25.05.2015. Subsequently, the daughter of the informant gave birth to a male child but the daughter of the informant suspected that her husband Ramjeet Yadav had illicit relationship with the petitioner, who happens to be sister-in-law (Bhabhi) of the husband of the daughter of the informant. It is also alleged that husband of the daughter of the informant and this petitioner used to torture the

Ultimately the informant received information that his daughter and the minor grandchild have received burn injuries then the informant reached to the Referral Hospital, Raghunathpur but found that the doctor has referred her to Sadar Hospital, Siwan and from there to PMCH. Ultimately, the daughter of the informant and her child succumbed to the injuries. It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. The informant committed suicide. The thrust of accusation is against the husband of the daughter of the informant, Ramjeet Yadav, who has ultimately been acquitted vide judgment dated 16.09.2017 passed by learned 5th Additional Sessions Judge, Siwan in Sessions Trial No. 320 of 2016.
Considering the fact that the main accused, the husband of the daughter of the informant has been acquitted and petitioner being a lady, it is a case for consideration of prayer for regular bail by the learned Court below, if the petitioner surrenders before the learned Court below within a period of six weeks from today in connection with Raghunathpur P.S. Case No. 36 of 2016 pending in the Court of learned Additional Chief Judicial Magistrate-IV, Siwan. It is expected from the learned Court below
Patna High Court Cr.Misc. No.52078 of 2017 (2) dt.24-01-2018 to dispose of the bail application of the petitioner preferably on the same day.
