Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341, 323,324, 354B, 379, 504, 506, 34 of the Indian Penal Code.

Allegation against these petitioners is that they along with other co-accused persons armed with weapons assaulted the informant and his wife. It is further alleged that co-accused Chandan (Petitioner no. 1) tried to outrage the modesty of the

Patna High Court CR. MISC. No.31690 of 2023(2) dt.14-07-2023 2/2 wife of the informant and petitioner no. 4 snatched the earring. It is submitted that due pre-existing land dispute, simple marpit took place between the parties. During investigation, the allegation under Section 354B of I.P.C. was disbelieved, rather the case was found true under Section 324 of the I.P.C. Doctor has found simple injury. Petitioners have got clean antecedent.

Learned counsel for the State vehemently opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No. 268 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
