1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 304B, 120B and 34 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that Basath Pandit had approached this Court, seeking regular bail by filing Cr. Misc. No. 308082 of 2020 and the same was allowed by an order dated 19.01.2021. It is further submitted that Basath Pandit was implicated in the case being father-inlaw of the deceased. It is next submitted that the petitioner is the mother-in-law and is in custody since 17.02.2024 and chargesheet has been submitted. It is also submitted that the petitioner

4. The learned APP for the State opposes the regular bail application of the petitioner.

5. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court of S.D.J.M., Sikarhana at Dhaka in East Champaran in connection with Chiraiya P.S. Case No. 542 of 2019.

6. However, it is made clear that if the learned trial court comes to a conclusion that the petitioner after her release, is trying to delay the trial in any manner, in that event, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.

7. The application stands allowed.
