The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 395, 412 of the Indian Penal Code.

It is alleged that three accused persons riding on a motorcycle have snatched Rs. 86,8255 from the informant.

It is submitted by learned counsel for the petitioner that F.I.R has been registered against

Patna High Court CR. MISC. No.38194 of 2021(4) dt.30-08-2022 2/3 unknown. The name of the petitioner sprang up only on the confessional statement of co-accused Sonu Kumar, Raja Kumar. It is further submitted that petitioner was not apprehended from the spot. Nothing has been recovered from the conscious possession of the petitioner. There is no material evidence collected against the petitioner. The confessional statement given in respect of this petitioner is not admissible in the eyes of law. A statement has been made in para 3 of the petition that petitioner is accused in one other case apart from the present one.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Rajauli P.S. Case No. 404 of 2020,
