23-12-2016 Heard Sri Krishna Prasad Singh, learned senior counsel assisted by Sri Bhaskar Shankar, learned counsel for petitioners and learned Addl. Public Prosecutor. Three petitioners, who are in-laws of the informant, have prayed for grant of anticipatory bail in Bakhtiyarpur P.S. Case No. 251 of 2016 registered for offence under Sections 498(A), 379, 327, 323, 324, 341/34 of the Indian Penal Code. Sri Singh, learned senior counsel for petitioners, by way of referring to F.I.R., submits that in the F.I.R., save and except the fact that petitioners have been arrayed as accused with general and omnibus allegation, all allegations have been levelled
Patna High Court Cr.Misc. No.55317 of 2016 (2) dt.23-12-2016 2/2 against her husband regarding demand of dowry as well as torture. Besides hearing, I have also perused the materials on record, particularly the F.I.R. Considering the fact that in the F.I.R., mainly allegation has been levelled against the husband, there is no reason to deny the prayer for grant of anticipatory bail to the petitioners.
Accordingly, in the event of arrest or surrender within a period of six weeks from today, let aforesaid three petitioners namely 1. Shoheb Alam @ Md. Shoaib Alam, 2. Bibi Mazara Khatoon @ Babi Mazara, and 3. Md. Kauser @ Md. Kausar Alam be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 251 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) Anay U T
