Petitioner seeks regular bail in connection with Katra P.S. Case No. 26 of 2021 registered for the offence under Sections 279, 337 , 338, 304 (A) of the I.P.C., Section 37(c) of the Bihar Prohibition and Excise Act, 2016.
Allegation is that the petitioner in drunken condition was driving the tractor rashly and negligently and dashed the son of the informant due to which he died.
Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged and the fact that petitioner was in drunken condition or not has not been established by blood test or breath analyzer test of the petitioner. No.38019 of 2021(2) dt.07-01-2022 2/2 bailable, except Section 37 (c) of the Bihar Prohibition and Excise Act, 2016 ingredient of which is not available on the record, the co-accused has been granted bail by the lower court itself and the petitioner is in custody since 12.02.2021. Regard being had to the submissions made by the parties, taking into consideration the materials available on record, the fact that petitioner is in custody since 12/02/2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.
Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 25000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Katra P.S. Case No. 26 of 2021. (Anil Kumar Sinha, J) praful/- U T
