This is a petition for grant of anticipatory bail for offence under Sections 420 of the Indian Penal Code and 7 of the Essential Commodities Act.
The petitioner is a public distribution system dealer. Allegation is that she had sole the food grains on higher price to the consumers.
Submission of the petitioner is that the aforesaid was complaint before the informant and no evidence was collected during enquiry to come to the conclusion and on enquiry the allegation was found to be true. The informant has suo motu lodged the case assuming that the allegation is correct. Considering that the petitioner, above named, has got no criminal antecedent as well as the fact that she is a female, in the event of her arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Jamalpur P.S. Case No. 94 of 2016 to the satisfaction of the Subdivisional Judicial Magistrate, Munger, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
