06-12-2016 Heard Sri Bhavesh Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is father-in-law of the informant, has prayed for grant of anticipatory bail in Mahila Nawada P.S. Case No. 68 of 2015 registered for offence under Sections 498(A), 323, 341, 307 of the Indian Penal Code and Sections 3 & 4 of the Dowry Prohibition Act, 1961.
By way of referring to F.I.R., it was submitted by learned counsel for the petitioner that the informant in the F.I.R. has made all allegations against her husband. Save and except the fact that petitioner has been arrayed as accused in the F.I.R., there is no specific accusation against the petitioner. He submits that the husband of the informant after being remained in custody for
Patna High Court Cr.Misc. No.48592 of 2016 (4) dt.06-12-2016 2/2 sufficient period, a Bench of this Court, vide order dated 25-04-2016 passed in Cr. Misc. No. 15861 of 2016, has enlarged him on bail, on the ground that he was ready to keep the informant as wife with respect and dignity.
Considering the facts and circumstances, particularly the fact that there is no specific accusation against the petitioner, who is father-in-law of the informant, as well as the fact that husband of the informant has been granted bail, there is no reason to deny the prayer for grant of anticipatory bail to the petitioner. Accordingly, in the event of arrest or surrender within a period of six weeks from today, let the petitioner namely Ramadhin Yadav be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. - III, Nawada in connection with Nawada Mahila P.S. Case No. 68 of 2015, subject to condition as laid down under Section 438(2) of the Cr.P.C. (Rakesh Kumar, J.) Anay U T
