26-06-2018 Heard Sri Sanjeev Ranjan, learned counsel for the petitioner and Mr. Md. Nazir Ansari, learned Addl. Public Prosecutor.

The sole petitioner, apprehending his arrest in Piar P.S. Case No. 153 of 2017 registered for offence under Sections 272 & 273 of the Indian Penal Code and Sections 30(a), 38(II), 41 & 47 of the Bihar Prohibition and Excise Act, 2016, has prayed for grant of bail, in the event of his arrest or surrender. By way of referring to F.I.R., learned counsel for the petitioner submits that despite the fact that nothing was recovered either from conscious possession of the petitioner or from his premises, petitioner has been made accused only on the basis of secret information. Learned counsel for the petitioner further submits that it is true that petitioner was earlier made

Patna High Court Cr.Misc. No.31766 of 2018(5) dt.26-06-2018 2/2 accused in two cases, but he was never involved in any case relating to Excise Act.

Considering the fact that nothing was recovered from conscious possession of the petitioner, in the event of his arrest or surrender within a period of six weeks from today, let the petitioner namely Sachin Singh @ Sachin Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Piar P.S. Case No. 153 of 2017, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
