====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 06-05-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Nayagaon P.S. Case No. 08 of 2019, instituted for the offence under Section(s) 420, 406, 341, 323, 504 and 506/34 of Indian Penal Code. It is alleged in the written report that on 11.10.2017, the informant paid amount of Rs.3,20,000/- to the petitioner and his brother in presence of wife of the informant to purchase his land, but petitioner neither executed the sale deed nor returned money to the informant.

Counsel for the petitioner submits that money is alleged to be given to petitioner on 11.10.2017. The instant case has been lodged on 6.2.2019. There is no document to support

Patna High Court CR. MISC. No.29075 of 2019(2 ) dt.06-05-2019 2/2 the payment of Rs.3,20,000/- to the petitioner by the informant. Petitioner is in custody since 18.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Begusarai, in connection with Nayagaon P.S. Case No. 08 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
