Petitioner seeks bail in Surajgarha P.S. Case No.228 of 2018 instituted for the offence under Section(s) 302, 394/34 Indian Penal Code and Section 27 of the Arms Act. Counsel for the petitioner submits that petitioner is named in the First Information Report, but there is no specific allegation of overt act against him. He is alleged to be member of an unlawful assembly.

As per written report, specific allegation of causing firearm injury on head of Dewar of the informant, Bipin Yadav, is against Bhikhari Singh. Dewar of the informant subsequently died.

There is general and omnibus allegation against the

Petitioner is in custody since 19.11.2018.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Lakhisarai, in connection with Surajgarha P.S. Case No.228 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
