The petitioner is accused in connection with Sessions Trial No. 35 of 2017/489 of 2017 arising out of Barachatti P.S. Case No. 38 of 2015 registered under Section 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the prayer for bail of the petitioner was earlier rejected twice, lastly, on 05.09.2018 passed in Cr. Misc. No. 29856 of 2018 by this Court with direction to the trial court to conclude the trial of the petitioner within six months by taking all effective steps, while the charge has been framed on 08.01.2018.

Patna High Court CR. MISC. No.27244 of 2019(3) dt.03-07-2019 2/2 been received through letter no. 197 dated 22.05.2019, from the court of Additional Sessions Judge-III, Gaya, which shows that in spite of issuing summon and non-bailable warrant, not a single witness has been turned up.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-IX, Gaya, in connection with Sessions Trial No. 35 of 2017/489 of 2017 arising out of Barachatti P.S.
