The petitioner seeks bail in connection with Gaya Excise Case No. 148 of 2020 for the offence under Sections 30(a) and 56(b) of the Bihar Prohibition of Excise Act. Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. Nothing has been recovered from the conscious possession of the petitioner and the petitioner has no concern with the alleged recovery. The petitioner is rotting in judicial custody since 07.03.2020.

Considering the facts and circumstances of the

Patna High Court CR. MISC. No.30660 of 2020(2) dt.11-12-2020 2/2 case, let the, above named, petitioner be released on bail on furnishing his personal bond to the satisfaction of learned Special Excise Judge, Gaya in connection with Gaya Excise Case No. 148 of 2020.
