JUSTICE DINESH KUMAR SINGH ORAL ORDER 02/ 11-01-2017 The present application has been filed for modification of order dated 12.04.2016 passed in Cr. Misc. No. 43545 of 2015 to the extent that the prayer for bail of the petitioner may be considered afresh since as now the petitioner is ready to make payment of the permanent alimony through at earlier occasion the issue could not be reconciled due to some dispute with regard to the quantum of permanent alimony. The order dated 12.04.2016 reflects that the issue could not be resolved earlier since the petitioner performed second marriage and there was some dispute with regard to quantum of permanent alimony.

Let the learned court below consider the

Patna High Court Cr.Misc. No.51896 of 2016 (2) dt.11-01-2017 2/2 prayer for bail of the petitioner provisionally in order to get the issue reconciled on payment of permanent alimony within a period of two weeks.

Accordingly, this modification application is disposed of.

Let the order be transmitted to the court of learned CJM, Saran at Chapra in connection with Complaint Case No. 150 of 2015.
