Petitioner seeks bail in a case registered for the offences punishable under Sections 376/506 of the Indian Penal Code and Section 4/6 of the Protection of Children from Sexual Offences Act.

Allegation against the petitioner is that he ravished to a minor girl. The victim has supported the allegation. On merit, prayer for bail to the petitioner was refused on 10.01.2020 in Cr. Misc. No. 73414 of 2019. Learned counsel for the informant informs the Court that prosecution evidence is likely to conclude within 4-5 dates fixed before the learned court below provided everyone is available and cooperative thereat.

No.29101 of 2020(4) dt.01-03-2021 2/2 Considering the nature of allegation and no fresh material for review the prayer of earlier rejection of bail, I am not inclined to enlarge the petitioner on bail in connection with Mahila (Sadar) P.S.Case No.23 of 2019 pending in the court of learned 1st Additional Sessions Judge-cum-Special Judge (POCSO) Act, Darbhanga. Prayer is refused.

Petitioner is in custody since 05.09.2019. Hence, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest without allowing any unnecessary and long adjournment in the case.

Let the S.P., Darbhanga be informed to ensure production of all the prosecution witnesses including the official witnesses in connection with Darbhanga Mahila (Sadar) P.S.Case No.23 of 2019.
