JUSTICE SUDHIR SINGH ORAL ORDER 23-11-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 147, 188, 409 and 420 of the Indian Penal Code.

Allegation against petitioner is that he did not submit the educational certificate and merit list of primary teachers appointment to the Vigilance Department for investigation. It is submitted on behalf of petitioner that petitioner has falsely been implicated in the present case. There is no allegation of tampering of witnesses against him. Petitioner is a Panchayat Secretary of the Panchayat. It has been alleged that petitioner had not deposited the document relating to appointment of teachers from 2003 to 2010. From perusal of Annexure-4 it is evident that the entire document has already been deposited by petitioner before the Block Educational Office.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his/her arrest or surrender

Patna High Court Cr.Misc. No.50187 of 2016 (2) dt.23-11-2016 2/2 in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani, in connection with Madhubani Town P.S. Case no. 304 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
