The petitioner apprehends his arrest in connection with Shambhuganj P.S. Case No. 48 of 2018, registered under Section 379 of the Indian Penal Code, pending in the court of the S.D.J.M. Banka.
The accusation is that the informant Murlidhar Singh, after withdrawing Rs.40,000/- from the S.B.I. Shambhuganj branch kept the same in the dickey of his motorcycle. Thereafter, he parked his motorcycle in front of a shop for purchasing of some articles. In the meantime, one unknown person came there and broke the lock of his dickey and took the money and started fleeing, while he tried to catch that person, but that person succeeded to flee away. The
Patna High Court Cr.Misc. No.31201 of 2018(2) dt.11-06-2018 2/2 persons present on the spot disclosed the name of Subodh Kumar (Petitioner), as miscreant, who succeeded to flee away. Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner was not apprehended from the spot, rather, he was identified by the persons, who were present on the place of occurrence. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trial Court within four weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
