13-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Kanti P.S. Case No. 349 of 2020, registered for the offence under Sections 8, 20(b)(ii)(c) and 22(c) of the N.D.P.S. Act.

As per the F.I.R., one kg. ganja has been recovered from the possession of co-accused Baidnath Sahni and 500 gm. of ganja has been recovered from the joint possession of this petitioner and other two co-accused persons.

It is submitted on behalf of petitioner that petitioner claims clean antecedent and the alleged ganja i.e. 500 gm., which has been recovered from joint possession of petitioner and other two co-accused, is less than small quantity. Petitioner is in custody since 21.06.2020.

Learned A.P.P. for the State has opposed the bail petition.

Patna High Court CR. MISC. No.38725 of 2021(2) dt.13-12-2021 2/2 Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Addl. Sessions Judge, Muzaffarpur in connection with Kanti P.S. Case No. 349 of 2020.
