The petitioner is apprehending his arrest in a complaint case, wherein processes have been directed to be issued after cognizance being taken for the offences punishable under Sections 417, 418 and 420 of the Indian Penal Code. The prosecution case is that the complainant entered into an agreement for transfer of one katha of land for consideration amount of Rs.2,00,000/- but in the agreement the area of the land has maliciously been recorded by the petitioner as 26 decimals, instead of one katha.

Patna High Court Cr.Misc. No.61974 of 2017 (2) dt.22-12-2017 2/2 It is submitted by learned counsel for the petitioner that for a civil nature of dispute, the present case has been lodged. A statement has been made in paragraph 3 of the petition that the petitioner is not having any criminal antecedent. Considering the accusation arising out of a contractual nature of dispute between the parties, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Buxar in connection with Complaint Case No. 1122(C) of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
