This application is for grant of anticipatory bail for the offence under Sections 307 and other Sections of the Indian Penal Code.
It has been submitted on behalf of the petitioners that there is no specific allegation against any of the petitioners rather the accused persons assaulted the petitioners by surrounding them, however, from perusal of the impugned order, it appears that the statement of the injured was taken in Para 38 of the case diary,
Patna High Court Cr.Misc. No.52899 of 2016 (2) dt.21-12-2016 2/2 which shows that the injured, as alleged, has been assaulted by Satyendra Sah by 'Daab' on head, which is grievous in nature. It has also been submitted that there are case and counter case.
Heard learned A.P.P. also.
Having heard both sides and in view of the fact that the allegation of assault by 'Daab' on the head of the informant is against Satyendra Sah and the allegation against the petitioners are omnibus and there is no specific allegation against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of ACJM 8th, Saran at Chapra in connection with Mashrak P.S.Case No.157 of 2016, subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
