Mr.Pranav Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420, 504, 506 and other allied sections of Indian Penal Code.
As per prosecution case, informant alleges that her son was murdered and all the FIR named accused persons misappropriated an amount of Rs. 5,49,218/- after putting forged signature of the informant.
Learned counsel appearing for the petitioner submits that the petitioner is ready to deposit 50 per cent of the total amount Rs. 5,49,218/- within 2 years. Petitioner has got clean antecedent.
Considering the fact that petitioner is ready to refund 50 per cent of the total amount, let the above named petitioner
Patna High Court CR. MISC. No.30086 of 2022(3) dt.01-11-2022 2/2 in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Muzaffarpur West in Kanti P. S. Case No. 538 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that the petitioner shall deposit Rs. 50,000/- (fifty thousand) through Bank Draft to the informant at the time of furnishing bail-bond and rest amount in four installments shall be refunded to the informant within a period of two years from the date of furnishing bailbond failing which the learned Court below would be at liberty to cancel the bail bond. The said deposit shall be subject to final outcome of the case.
