JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Bagaha P.S. Case No. 108 of 2020 registered for the offence under Sections 414/34 of the Indian Penal Code and Section 33 of Bihar Prohibition and Excise Act.

As per the prosecution case, 300 liters of spirit has been recovered from a Bolero car and one co-accused Jaiprakash Yadav, who was apprehended on the spot, disclosed the name of petitioner, as one of the associates, who fled away. It is submitted on behalf of petitioner that nothing has been recovered from the possession of the petitioner. Petitioner is neither owner nor driver of Bolero in question. Petitioner has no concern with the seized spirit.

In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Bettiah, West Champaran in connection with Bagaha P.S. Case No. 108 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
