Earlier, the anticipatory bail application of this petitioner was dismissed by this Court vide order dated 13.10.2022 passed in Cr. Misc. No.55633 of 2021. This is the second attempt of the petitioner for grant of anticipatory bail.

Petitioner apprehends his arrest in connection with Siwan Muffasil (Mahadeva O.P.) P.S. Case No.276 of 2021, dated 17.06.2021, registered for the offence punishable u/s 304 of the IPC, pending in the Court of learned Chief Judicial Magistrate, Siwan.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application.

Patna High Court CR. MISC. No.34136 of 2023(2) dt.28-06-2023 2/2 Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the learned Court below within six weeks from today and seek regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application.
