====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 24-05-2018 Heard learned counsel for the petitioner and the State. Petitioner is apprehending his arrest in Shambhuganj P.S. Case No.36 of 2014 for the offences registered under Section 366(A) of the Indian Penal Code.
Informant in his written report has alleged that petitioner along with co-accused misbehaved with informant's daughter and thereafter informant had given information to the Police Station. It is further alleged that petitioner had kidnapped her daughter.
It has been contended on behalf of the petitioner that he is innocent and committed no offence. He has falsely been implicated in this case on mere suspicion. The victim in her statement recorded under Section 164 Cr.P.C. has not taken the name of petitioner. He has got no criminal antecedent. Similarly situated co-accused Tinku Singh has been enlarged on bail by a Bench of this Court vide Criminal Misc. No.54370 of 2017.

No.31129 of 2018(2) dt.24-05-2018 2/2 Considering the facts and circumstances of the present case, let petitioner, above named, in the event of arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.10,000/ (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrte, Banka, in Shambhuganj P.
