The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code.
Allegation is that accused Hirdailal Yadav assaulted on the head of the father of the informant by large stone, due to which he became injured and fell down. Thereafter the petitioner assaulted him by stick. The father of the informant was taken to Hospital for treatment, but in the way he died. It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.12.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. Patna High Court CR. MISC. No.27119 of 2019(2) dt.26-04-2019 2/2 accused Hirdailal Yadav, who is alleged to have assaulted on the head of the deceased. Postmortem report corroborates the allegations made in the F.I.R. So far the petitioner is concerned, no specific injury is attributed against him. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jamui in connection with Jamui P.S. case No.211 of 2018.
